GENERAL TERMS AND CONDITIONS OF SALE

The general terms and conditions of sale set out below define the contractual relationship between Petit Nuage, a SAS with capital of 1,000 euros, whose registered office is located at 13 rue Simone Veil, 93400 Saint Ouen, France, and registered in the Bobigny Trade and Companies Register under number 980 145 619 (hereinafter referred to as "Petit Nuage"), and the Customer.

These General Terms and Conditions of Sale govern the contractual relationship between Petit Nuage (hereinafter "Petit Nuage") and the Customer, who is a private individual. Special conditions apply to professionals, in particular for the organization of birthdays or events, as well as for the rental of premises.

Any use of the services offered by Petit Nuage implies unreserved acceptance of these General Terms and Conditions of Sale, which prevail over any other general or specific conditions not expressly validated by Petit Nuage. The customer acknowledges having read and accepted these General Terms and Conditions of Sale before making any reservation on the Petit Nuage website.

SERVICES: PLAYGROUND, CAFÉ AREA, BIRTHDAY PARTIES, WORKSHOPS

PLAYGROUND AND CAFE AREA :

Petit Nuage is a playground with coffee facilities.

Booking online or buying tickets at the counter gives access to the playground for a set period, according to school vacation periods, days of the week and time slots. An accompanying adult must always be present in the play area with the children. Parents and accompanying adults remain fully responsible for their children. It is particularly important to supervise children under 3 years of age, as small objects may be present, potentially moved and left behind by other playground users.

Bookings for groups of more than 4 adults may be cancelled at least 72 hours in advance, as large group bookings (particularly for birthdays) are not permitted via the website. You will need to contact the facility during opening hours to inquire about birthday rates and check availability for the requested slots.

- Reservations are only confirmed once full payment has been received, either by credit card via our secure website (reservation module managed by EventCalendar), or directly at the Petit Nuage counter.

- After your transaction, a confirmation e-mail and proof of payment will be sent to the address associated with your reservation.

- Reservations cannot be changed and no refunds are possible.

- In the event of cancellation at least 48 hours before the scheduled date, it will be possible to convert the reservation into a credit note for another slot, subject to availability. This credit note is valid for 1 year.

Access with a ticket:

- Customers present themselves with the name given at the time of booking or the email address used. A check is made to verify the time and number of tickets purchased.

Access conditions:

- Anyone wishing to enter Petit Nuage must pay an admission fee, which gives them access to the entire playground on the day of their visit.

-All exits are final.

- Only children accompanied by an adult are allowed in the play area.

- All children in the play area must be under the responsibility and supervision of an adult over 18.

- Smoking, vaping, bringing in alcohol and pets are not permitted. The use of electronic cigarettes is also prohibited.

- Eating food on the playground is forbidden; an area with benches is provided for this purpose.

‍Responsibilities:

- Children in the play area are under the full responsibility and supervision of accompanying adults.

- Petit Nuage declines all responsibility for any damage or accident occurring in the absence of appropriate supervision, or in the event of use of the play structures under non-compliant conditions.

- Any damage caused to the structures by a child or adult will be entirely the responsibility of the accompanying adult, and may give rise to a claim for compensation.

- Petit Nuage cannot be held responsible for theft, loss or damage to personal belongings left on the premises.

WORKSHOPS :

Services are offered in the form of workshops for children (accompanied or unaccompanied, from age 3), accompanied babies, families and adults. These workshops, held on Petit Nuage premises, are led by specialized, experienced or BAFA-qualified instructors, and run for a period specified at the time of booking, with or without commitment depending on the options chosen.

Workshops purchased are nominative, non-transferable and may only be refunded in accordance with the conditions set out in these GTC. Depending on the workshop selected, responsibility lies with the accompanying adult for babies, children or families, with the instructor for unaccompanied children, and with the customer for adult workshops. The purchase of a ticket for a workshop does not give access to the playground. Access to the playground is authorized only if a ticket has been purchased following the workshop.

For the latter, the customer certifies that he/she fully understands the physical exercises proposed and that his/her physical condition and state of health allow him/her to participate in these activities. The customer releases Petit Nuage, its managers and instructors from any liability or legal action relating to any injury or damage resulting from the activity. The customer accepts full responsibility for the risks and consequences of participating in Petit Nuage activities.

Registration

Registration will only be considered definitive once full payment has been received for the chosen workshop and confirmation of availability has been received. All participants must be covered by civil liability insurance, whether for themselves, their children or their families. Once the registration has been confirmed, it cannot be cancelled in advance, except in the cases provided for in these general terms and conditions of sale.

Cancellations and absences

Because of Petit Nuage

Petit Nuage reserves the right to cancel an annual or quarterly workshop, course or session if the number of participants is less than 5 (children, babies, families or adults), by informing the customer at least 48 hours in advance. In the event of cancellation by Petit Nuage, the corresponding amount will be reimbursed in full. If the cancellation occurs during the year, the refund will be prorated for the remaining sessions. If Petit Nuage cancels a session, it will be rescheduled for a later date, by mutual agreement if possible. If rescheduling is not possible, the corresponding amount will be reimbursed in full.

Customer's fault

Cancellations or no-shows for multiple workshop commitments

No refunds will be given if the child, baby, family or adult is absent from a scheduled and paid session. All scheduled absences must be notified by e-mail to the following address: contact@lepetitnuage.fr, at least two days before the date of the workshop or booking concerned. A postponement may be considered, subject to availability, and will be limited to one replacement per period concerned. Notification of absence and replacement requests will not be accepted by telephone or verbally.

Cancellation of unit workshops

The customer may cancel any session booking up to two days before the scheduled class or session time, by sending an email to contact@lepetitnuage.fr. In this case, Petit Nuage will reimburse the customer for the costs incurred. Cancellations received after this time will not be reimbursed.

RATES

The prices in force are those applicable on the date of purchase (excluding current promotions) and displayed on the website. Prices are shown inclusive of all taxes. Petit Nuage reserves the right to adjust course prices in the event of new taxes or rate increases, as from their entry into force.

Petit Nuage may modify its prices at any time, but the price indicated on the website or directly at the counter at the time of purchase will be the only one applicable. The schedule can be consulted on the Eventcalendar platform and on the www.lepetitnuage.fr website . Schedules may be reduced or adjusted during school vacations or according to variations in demand.

Some slots are payable at the counter only, while others can be booked online.

TERMS OF PAYMENT

Playground and workshop tickets must be paid for in advance by credit card via the online booking site. Customers can also pay on site at Petit Nuage for playground access, workshops and birthday parties, either individually or as a package/subscription, by credit card or in cash. Cheques are not accepted.

PROVISION OF SERVICES

Availability of speakers/professionals/teachers and staff

Petit Nuage uses the services of professional facilitators. It may be necessary for Petit Nuage to change speakers before a workshop. Whenever possible, customers will be informed in advance. There is no right to have a workshop or course run by a specific instructor.

Petit Nuage is the sole arbiter of group composition (age). Numbers and age groups mentioned are provided for information only and may vary according to workshops, days, schedules and availability.

Access to courses or workshops and lateness

Access to classes or workshops is permitted no earlier than 10 minutes before the scheduled start time and no later than 10 minutes after the start time. Petit Nuage reserves the right to refuse access to the class or workshop if these rules are not respected.

Access to a workshop does not give access to the playground. If the customer wishes to continue with access to the playground, he or she must purchase as many tickets as there are people in the workshop.

ANNIVERSARY:

Several birthday packages are available.

Reservation of a birthday slot is confirmed upon payment of a 50% deposit (by bank transfer or credit card directly at the Petit Nuage counter). The customer must respect the reserved times so as not to disrupt Petit Nuage's business.

If the reserved time is exceeded, Petit Nuage reserves the right to apply a penalty in the form of a lump sum, which will be specified to the customer when the order is recapitulated. A deposit may also be required for large groups.

It is strictly forbidden to bring alcohol onto the premises. In the event of non-compliance with this rule, Petit Nuage reserves the right to terminate the service and ask the customer to leave the premises immediately.

LIFE RULES

Behavior and discipline

Each customer agrees to behave in a respectful and courteous manner, and to act appropriately towards all persons present on the premises. In the event of persistent inappropriate behavior by a child, baby, family or adult that interferes with the proper conduct of play sessions or workshops, Petit Nuage reserves the right to exclude the person concerned, either temporarily or permanently, after an initial warning has had no effect. Petit Nuage will retain full payment for the services provided.

Violence and aggression, whether verbal or physical, will not be tolerated, whether directed at a child, another Petit Nuage customer or staff.

Customers are expected to respect the premises and to maintain them in the condition in which they found them. This includes putting toys away and encouraging children to do the same, as well as taking care of the equipment provided and cleaning up after themselves (changing table, stroller room, toilets, etc.). The customer also undertakes to remove his/her shoes when entering the play area.

‍DROITA L'IMAGE

Petit Nuage is authorized, unless parents advise otherwise, to photograph or film children, babies, families and adults during animation sessions, classes or events related to its group activities. These images will be used solely for distribution on Petit Nuage's internet platforms. Any refusal or limitation concerning this distribution must be clearly stated.

WARRANTY, LIABILITY AND INSURANCE

As part of their activities at Petit Nuage, customers undertake to take out civil liability insurance for themselves and for the child or family registered. They also undertake to ensure that their child is up to date with compulsory vaccinations and free from potentially infectious diseases.

Petit Nuage declines all responsibility in the event of non-achievement of the children's learning objectives, being bound only by an obligation of means in this respect. Petit Nuage is regularly covered by professional liability insurance for the services provided. However, Petit Nuage cannot under any circumstances be held responsible for the loss, theft or deterioration of personal objects belonging to the children or the customer. The supervisor appointed by the customer, and the parent of the child accompanied, undertake to be insured in accordance with current legislation, and to check the validity of their insurance before coming to the premises.

MATERIALS AND INTELLECTUAL PROPERTY

All material made available and used as part of the services offered by Petit Nuage or its service providers remains their exclusive property. All elements relating to the content of Petit Nuage services and web spaces are the exclusive intellectual property of their owners. It is strictly forbidden to reproduce, exploit, redistribute or use in any way whatsoever, even partially, these elements, in any form or medium whatsoever, without the prior written consent of Petit Nuage.

PERSONAL DATA

In accordance with the French Data Protection Act of January 6, 1978, customers have the right to access, modify, rectify, oppose the use of and request the deletion of their personal data. This right may be exercised by contacting Petit Nuage, located at 13 rue Simone Veil, 93400 Saint-Ouen.

COMPETENT JURISDICTION

All disputes relating to the purchase and sale operations governed by these general terms and conditions of sale, concerning their validity, interpretation, execution, termination, consequences and consequences, which could not be resolved amicably between the seller and the customer, will be brought before the competent courts in accordance with common law. The customer is informed that he/she may also have recourse to conventional mediation, in particular with the Commission de la médiation de la consommation (art. L 534-7) or other existing sectoral mediation bodies, as well as to any alternative dispute resolution method (such as conciliation) in the event of a dispute.

PRE-CONTRACTUAL INFORMATION AND CUSTOMER ACCEPTANCE

The customer acknowledges having read and understood, prior to purchase, the present General Terms and Conditions of Sale, as well as all the information mentioned in article L.121-17 of the French Consumer Code, in particular the following information:

- essential features of the service ;

- in the event of immediate non-performance of the contract, the date or deadline by which the service provider undertakes to provide the services purchased;

- information concerning the identity of the service provider, its postal, telephone and electronic contact details, as well as its activities, if these are not obvious;

- Information on legal and contractual warranties and how to make use of them;

- the possibility of resorting to conventional mediation in the event of a dispute.

The fact that an individual or legal entity makes an immediate purchase or orders a service implies full acceptance of these General Terms and Conditions of Sale and the obligation to pay for the services ordered. The customer expressly acknowledges this and, in particular, waives the right to invoke any contradictory document that may be unenforceable against the service provider.

ERRORS AND INACCURACIES

We endeavor to provide complete, accurate and up-to-date information on our website. However, we cannot guarantee the absence of human or technical errors. This site may contain typographical errors, inaccuracies or omissions, particularly with regard to rates, availability and service information.

PERSONAL DATA AND SECURITY

In accordance with the French Data Protection Act 78-17 of January 6, 1978, all personal data collected on this site has been declared to the CNIL (Commission Nationale de l'Informatique et des Libertés). Users have the right to access, modify, rectify and delete data concerning them. To exercise this right, the user should send an e-mail to: contact@lepetitnuage.fr.

Petit Nuage is committed to maintaining adequate security measures to protect the information you transmit. However, despite reasonable precautions taken to protect such personal data from unauthorized access, use or disclosure, we cannot guarantee that data transmission over the Internet is completely secure against access by unauthorized third parties. Petit Nuage shall not be held liable for any breach of security, unless such breach is due to negligence on its part.

LAW - APPLICABLE JURISDICTION

The terms and conditions of sale, as well as the contractual relationship between Petit Nuage and the user, are governed by French law. The parties agree to submit to the jurisdiction of the courts of Bobigny (France) for any action brought in connection with these terms and conditions.
